SERVICE CONDITIONS

The terms of service for Monitority.com Monitoring System are listed below. By clicking "I Accept" or "Register" you agree to be bound by these terms. You can then proceed to our secure server to complete your registration and submit payment details. If you prefer to register by mail, click here to contact us for alternate arrangements

SERVICE

Company is to monitor one or more Internet Services (IS) on behalf of Customer and notify Customer if certain events occur during the monitoring process. Events for which notifications are sent are defined by Customer as part of his account maintenance. Notifications are sent by either email, GSM short message (SMS), Instant Message (IM). Customer must: (1) supply information required to set up his account, IS(s), notifications, and notification events; (2) provide for own access to the Internet and pay any (telephone service) fees associated with such access. If any information provided by Customer is inaccurate, Company retains the right to terminate Customer's customership and right to use the Service

CUSTOMER REPRESENTATION

1. The Customer affirms, for any IS tested by the Service through his account, that he is the legal owner of the IS, an employee of the legal owner of the domain, or has obtained express written permission from the legal owner of the domain for use of the Service in testing the domain. Customer expressly agrees to indemnify Company from any claims by a third party arising from use of the Service in testing an IS.
2. Customer grants Company permission to download files from any IS monitored by the Service as part of his account services. Customer understands that operation of the Service will involve repeated access by the Service to any IS monitored as part of his account services

PAYMENT

1. Your Monitority.com monthly subscription is billed on the first day of service. The subscription is automatically renewed and billed on successive billing dates.
2. The Monitority.com subscription can be canceled anytime for any reason.
3. No refunds of pre-paid subscription fees will be made.
4. Customer will not have access to Monitority.com portal following cancellation of service.

WARRANTY

1. You use Monitority.com services on Your own risk. Monitority.com doesn't take law responsibility about any damages You may do.
2. In case of incorrect work of service, Monitority.com may lower the price User paid.
3. WM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGE RESULTING FROM THE USE OF THE SERVICE OR THE INABILITY TO USE THE SERVICE OR FOR COST OF PROCUREMENT OF SUBSTITUTE SERVICES OR RESULTING FROM UNAUTHORIZED USE OF THE CUSTOMER'S ACCOUNT OR ACCOUNT INFORMATION OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE.

SECURITY

1. Monitority.com secures your personal information from unauthorized access, use or disclosure. Monitority.com secures the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to other Web sites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol or third-party partners site technology.

CHANGES IN TERMS OF USE

1. Monitority.com will occasionally update this Terms of Use to reflect company and customer feedback. Monitority.com encourages you to periodically review this Statement to be informed. After major changes You will be informed on Your actual e-mail provided in service.

SERVICE UPDATES

1. Monitority.com keeps the right to update, develop, change services, provide new, change design, layout, interface, functionality without User acceptation.

LINKS TO THIRD PARTY SITES

1. Monitority.com may contain links to third-party websites ("Linked Sites"). The Linked Sites are not under our control and we are not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. We are not responsible for webcasting or any other form of transmission received from any Linked Site. The Linked Sites are provided to you only as a convenience, and the inclusion of any Linked Site does not imply endorsement by us of the Linked Site or any association with its operators.

TERMINATION/ACCESS RESTRICTION

1. We reserve the right, in our sole discretion, to terminate your access to Monitority.com and the related services or any portion thereof at any time, immediately upon notice.

RESELLING

1. You can not sell without agreement with Monitority.com our services.

REFERENCES

1. You agree that we can use your company name and logo in connection with marketing and promoting Monitority.com.

NOTICES AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT

1. Pursuant to Title 17, United States Code, Section 512(c)(2), notifications of claimed copyright infringement under United States copyright law should be sent to info@monitority.com. ALL INQUIRIES NOT RELEVANT TO MONITORITY.COM WILL RECEIVE NO RESPONSE. See Notice and Procedure for Making Claims of Copyright Infringement.
